Terms and conditions

These terms and conditions form a legally binding agreement between you and UKcentric Ltd, the supplier of the Service. Your statutory rights are not affected.

Domain name registration

New registrations

UKcentric Ltd will use its best endeavours to effect the successful registration of a domain name itself or through its agents as requested by the Customer. UKcentric Ltd does not accept any liability whatsoever in failing to register such domain names requested by the Customer.

It is the Customer's responsibility to ensure that the details provided for whom a new domain is to be registered are correct and valid at the time of submitting a new domain name registration to UKcentric Ltd. Details must include the registrant's name, company or individual's name, full address, post code, country, a valid email address and international telephone number.

Cancellation of registrations

UKcentric Ltd does not operate a cancellation process for new domain name registrations or refund any charges in respect of the domain name registration.

Domain name transfers

Transfers to or from UKcentric Ltd are completed free of charge where UKcentric Ltd holds an account with a recognised registrar or naming authority. When requested to transfer a domain to another host UKcentric Ltd will endeavour to complete its obligation within 5 working days.

Where UKcentric Ltd is not the administration contact of a domain name UKcentric Ltd gives no warranties for the completion of any transfer.

Exception: No domain name can be transferred to an alternative host if a Customer's account is in arrears whether the domain is owned by the Customer or not.

Domain name renewals

Where UKcentric Ltd acts as the billing contact with a recognised registrar or naming authority UKcentric Ltd will via email advise the Customer of the due renewal of a domain name. If the Customer fails to respond to renewal notices the domain name shall not be renewed.

Amending domain name registrant's details

If UKcentric Ltd is the administration contact for a domain name the Customer will when appropriate request UKcentric Ltd to amend registrant's details accordingly. These changes will be effected by UKcentric Ltd free of charge except where a change of ownership is applicable.

Naming authority/registrar charges

Domain name registration/renewal fees will be paid by UKcentric Ltd on behalf of the Customer.

Use of domain names

The registration and use of domain names on the internet are subject to the relevant naming authority/registrar with whom the domain name have been registered.

All new domain registrations and registrar transfers for .com,.net,.org,.info,.biz are processed through by CSL GmbH d/b/a joker.com

Web site hosting

Server use

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

UKcentric Ltd reserves the right to refuse service and /or access to its servers to anyone.

UKcentric Ltd do not allow any of the following content to be stored on its servers:

Illegal Material - this includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of UKcentric Ltd.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Unlimited use policy

High bandwidth usage: UKcentric Ltd offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, UKcentric Ltd may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, UKcentric Ltd reserves the right to impose the High Resource User Policy for the consideration of all customers.

Resources are defined as bandwidth and/or processor utilization.

UKcentric Ltd may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available UKcentric Ltd reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby UKcentric Ltd continues hosting the website for an additional fee.

Payment policies

All accounts are set up on a prepay basis. Although UKcentric Ltd reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due every calendar month or 365 days, following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

In situations where the card number on file is declined UKcentric Ltd will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, UKcentric Ltd reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

All payment is in UK sterling.

Payment options

In order to streamline our accounting procedures and keep costs down UKcentric Ltd runs a limited number of payment options.

Credit / debit cards:

UKcentric Ltd accepts Mastercard, Visa (not Visa electron), Switch and Solo

Cheque payment:

This option is only available to customers who pay annually for their UKcentric Ltd account. A credit/debit card number will still be required if customers require the facility to purchase domains and other services on-line. UKcentric Ltd cannot guarantee that a service will be provided until after any received cheques have been cleared.

Cancellation and refunds

UKcentric Ltd reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes UKcentric Ltd's terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time. No prepaid web hosting fees can be refunded. Customer's web hosting services and email services will be stopped immediately upon receipt of cancellation.

In accordance with the Consumer Protection (Distance Selling) Regulations 2000, UKcentric cannot be held financially responsible for any mistakes made by Customers in placing their orders and no refunds can be given in the case of mistaken orders.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold UKcentric Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against UKcentric Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless UKcentric Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with UKcentric Ltd's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from UKcentric Ltd's server.

Disclaimer

UKcentric Ltd will not be responsible for any damages your business may suffer. UKcentric Ltd makes no warranties of any kind, expressed or implied for services we provide. UKcentric Ltd disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by UKcentric Ltd and its employees. UKcentric Ltd reserves the right to revise its policies at any time.
